Anthony Ostlund and the ACLU of Minnesota are pursuing a now-certified class-action lawsuit against Nobles County and its Sheriff for detaining immigrants for ICE without state law authority.
The district court granted a temporary restraining order to stop the Nobles County and its Sheriff’s practice, and Nobles County appealed the district court’s decision. On March 13, 2019, the State of Minnesota – through Attorney General Keith Ellison and Solicitor General Liz Kramer – filed a strongly worded brief requesting that the district court affirm the TRO. The Attorney General argued that Minnesota law does not authorize its law enforcement officers to detain people who would otherwise be released on the basis of documents sent by ICE.
