Kristin Rowell received a favorable jury verdict following trial in Hennepin County District Court in the case of Elizabeth Howell v. City of Minneapolis.
The case involved a determination regarding proper responsibility for a large retaining wall located in the Linden Hills neighborhood of the City of Minneapolis. The jury was tasked with deciding which party created the need for “lateral support” of the soil adjoining the retaining wall. The jury reviewed extremely old real estate documents and listened to days of expert testimony to determine why the retaining wall was constructed more than 100 years ago. The jury agreed with Kristin and her client and concluded that the City of Minneapolis created the need for lateral support of the soil adjoining the retaining wall, thereby necessitating the retaining wall. Kristin and her client expect Hennepin County District Court to issue several judicial declarations favoring Ms. Howell now that the jury has decided the fact questions.
