On June 27, 2019, an arbitrator awarded Anthony Ostlund’s client, Raitz Enterprises, more than $280,000 in damages, plus interest and attorneys’ fees, following the arbitration of a subcontract dispute. Phil Kaplan served as lead counsel for Raitz in the proceeding.
Raitz was a subcontractor on a large wind energy project in Texas. When the general contractor refused to pay all of Raitz’s invoices, Raitz started an arbitration proceeding against the general contractor under the American Arbitration Association (AAA) Construction Rules.
In April 2019, the parties had a two-day hearing in front of a single arbitrator. After hearing all of the evidence, the arbitrator decided the general contractor breached the parties’ subcontract and owed Raitz nearly all of the money it sought. The arbitrator also awarded Raitz all of the attorneys’ fees it spent on the case. Raitz recently received payment for the full amount of the award.
