Anthony Ostlund trial attorneys Janel Dressen and Rich Ostlund are very pleased that after hearing all of the evidence in their 5-day trial conducted in February 2017 in Hennepin County District Court that Chief Judge Bernhardson found in favor of Kim Lund, declaring her to be the “prevailing party,” and awarding her $45,225,000, plus court costs for her ownership in the Lunds & Byerly’s Companies.
The Court’s award is over $24,000,000 more than the Companies claimed Kim Lund’s ownership interests are worth. In an equally important decision, the Court removed Tres Lund, Kim’s brother, and the CEO of the Lunds Companies, as Kim’s trustee. This outcome confirms Minnesota’s long-standing protection of family business owners from unfair treatment.
Kim Lund stated in response to the decision that “I have always believed that privilege and wealth are community resources that should be used to lift all boats. My grandparents taught us that giving back to the community was our responsibility and our great joy. This has been my life’s work. I sincerely appreciate the Judge’s efforts and hope that my brother Tres will accept the Court’s decision so that the companies and our family can move on and get back to the work that benefits the community.”
