Courtland Merrill and Dan Hall successfully represented TSI, Incorporated at the United States Court of Appeals for the Federal Circuit.
TSI designs and produces instruments that sense and measure airborne particles. Inventor Aleksandr Yufa, Ph.D., sued TSI in the United States District Court for the Central District of California for alleged infringement of four patents. In September 2014, the district court granted summary judgment in favor of TSI, dismissing Dr. Yufa’s claims for lack of evidence of TSI’s infringement. The district court also awarded attorneys’ fees to TSI. Dr. Yufa appealed to the United States Court of Appeals for the Federal Circuit, which is the appellate court that hears appeals of all patent cases. On June 14, 2016, the Federal Circuit issued a written opinion affirming the district court’s judgment of non-infringement in favor of TSI in all respects. TSI was represented by Anthony Ostlund both in the district court and on appeal.
