Cases involving alleged breaches of fiduciary duties (for example, private company ownership relationships, trusts and estates, banking, investments, private equity companies, creditors rights, appraisal and valuation matters, insurance coverage, duties of officers and directors) have for the past five decades been a core area of experience and success for Anthony Ostlund’s trial attorneys, in courts and arbitrations both in Minnesota and across the nation.
This experience and reputation led the ABA Commercial Law Division in Washington, jointly with Thompson Reuters, to select Anthony Ostlund’s Rich Ostlund in 2015 as the lead author for its treatise sections regarding “Fiduciary Duty Claims”, as presented in the ABA’s Treatise “ Business and Commercial Litigation in the Federal Courts, Fourth Edition.“ Anthony Ostlund trial attorneys Dan Hall and Peter McElligott assisted in that extensive work, including in updating the work annually for the ABA from 2016 through 2021.
In January 2022, the ABA/Thompson West released the Fifth Edition of this highly respected multi-volume Treatise, with Anthony Ostlund again selected as the lead author nationally regarding fiduciary duty claims. The extensive work in 2021 on this updated edition featured AO partners Rich Ostlund and Dan Hall as lead authors, with great contributions, specifically acknowledged by the ABA, from AO attorneys Peter McElligott and Joe Janochoski.
Anthony Ostlund is honored to have been again chosen as an author of what has been broadly described by reviewing law journals across America as the most respected treatise on the art, science and knowledge needed to excel in preparing and trying complex business cases. The ABA’s New York based Editor in Chief for the just published Fifth Edition, early in 2022, declared that the authors of the Fifth Edition are the “cream of the commercial litigation bar” and as the “best lawyers practicing in the federal courts of this nation.”
Anthony Ostlund’s selection as a lead author for this treatise reflects a recognition of its deep expertise in complex commercial and financial rights litigation, particularly those involving a broad range of fiduciary duties.
